Welcome to HomeRasoi. These Terms of Service (“Terms”) govern your access to and use of our website, ordering flows, customer and staff portals, and related services (collectively, the “Services”). The Services are operated by HomeRasoi for fresh, home-style Indian meal delivery in the greater Houston, Texas area.

By creating an account, placing an order, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility & accounts

You must be able to form a binding contract in your jurisdiction and meet any minimum age requirements in your region (typically at least 18, or older if required locally). You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use.

2. Service description

HomeRasoi provides a platform to browse published menus, select meals and add-ons, schedule delivery dates within our published service windows, and communicate about orders. Menus, prices, delivery areas, windows, and cutoffs may change; we strive to display accurate information but occasional errors may occur.

3. Orders, pricing & payment

• Acceptance: an order is not confirmed until we (or our systems) acknowledge it and you receive confirmation according to our operational workflow. We may decline or cancel orders for operational, safety, fraud-prevention, or capacity reasons.
• Pricing: prices shown at checkout or on the site apply unless clearly stated otherwise. Taxes or fees, if applicable, will be disclosed where required.
• Payment: available payment methods (such as Zelle or cash on delivery) will be presented at order or account setup. You agree to pay all amounts when due and to provide accurate payment information.

4. Delivery area, windows & cutoffs

Delivery is limited to areas and ZIP codes we serve, as described on the site. Delivery windows and same-day or next-day cutoffs (for example, evening cutoffs for next-day lunch) are part of our operations; missing a cutoff may move an order to the next eligible date. You are responsible for ensuring address and drop-off instructions are accurate and accessible for drivers.

5. Weekly plans & subscriptions

If you enroll in a weekly or recurring plan, the Services may include features such as auto-renewal, skip days, or plan changes subject to published deadlines. You agree to review plan settings in your account and to any cutoffs we display for changes. Failure to meet a cutoff may limit changes for a given delivery day.

6. Cancellations, changes & refunds

Cancellation, change, and refund rules depend on order status, timing relative to our cutoffs, and operational feasibility. Where permitted, we will work in good faith to accommodate reasonable requests. Unless required by law, refunds are not guaranteed for orders already prepared or dispatched, or for missed deliveries due to incorrect addresses, unsafe access, or customer unavailability.

7. Food safety & allergies

While we take kitchen hygiene seriously, meals are prepared in a shared kitchen environment. If you have a severe allergy, you assume the risk of trace exposure unless we explicitly agree in writing to a different arrangement. You are responsible for reviewing ingredients and communicating dietary needs through the channels we provide.

8. Acceptable use

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to our systems, other users’ accounts, or non-public data.
• Interfere with or disrupt the Services, including by automated scraping that overloads our infrastructure.
• Misrepresent your identity or affiliation, or place fraudulent orders.

We may suspend or terminate access for conduct that we reasonably believe violates these Terms or harms others.

9. Intellectual property

The Services, including branding, text, graphics, menus, and software, are owned by HomeRasoi or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial ordering. No other rights are granted by implication.

10. Third-party services

The Services may integrate with third parties (for example, authentication, hosting, email, SMS, maps). Your use of those features may be subject to the third party’s terms. We are not responsible for third-party services outside our reasonable control.

11. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMERASOI AND OUR TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM IN THE THREE (3) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.

13. Indemnity

You will defend, indemnify, and hold harmless HomeRasoi and its owners, staff, and contractors from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.

14. Governing law & disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Subject to applicable law, you agree that exclusive jurisdiction for disputes will lie in the state or federal courts located in Harris County, Texas, and you consent to personal jurisdiction there.

15. Changes to the Services or Terms

We may modify the Services or these Terms at any time. We will post updated Terms on this page and update the “Last updated” date. For material changes, we may provide additional notice (for example, email or an in-app message). Your continued use after changes become effective constitutes acceptance. If you do not agree, stop using the Services.

16. Termination

You may stop using the Services at any time. We may suspend or terminate access with or without notice if we reasonably believe you violated these Terms, pose a security or legal risk, or if we discontinue the Services. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive termination.
